Workers’ Compensation. Workers’ Compensation is a scheme that was set up to pay for medical bills stemming from an on-the-job accident. This type of claim is made against your employer and is heard by a special judge who only hears Workers’ Compensation claims. With this type of claim, there are no damages as would be the case with a regular lawsuit. Instead, there are defined benefits that could be awarded that are meant to address your loss of income and costs of medical treatment. In this type of claim, you still must prove several things, including that you were injured on the job and the severity of your injuries.

Third-party claim. You may be in the position to bring a claim against someone who is not your employer, which is called a third-party claim. This sort of lawsuit would be brought if you were injured at the job site due to the negligence of someone who is not your employer (or employed by your employer). A common example is bringing a claim against someone who injured you who is employed by a different contractor or subcontractor. Additionally, you could bring a third-party lawsuit against the manufacturer of a faulty piece of equipment that injured you. Third-party claims allow for a wider range of damages than Workers’ Compensation claims.
